Mandatory working off of university graduates and PhDs

According to paragraph 17 of Article 47 of the Law of the Republic of Kazakhstan "On Education", as well as the Rules for sending young specialists to work (Decree of the Government of the Republic of Kazakhstan dated March 30, 2012 No. 390), three-year working off is mandatory for the following citizens:

1. Rural quota:

a. Since 2008 admissions (pedagogical and medical specialties);

b. Since 2012 admission (veterinary specialties);

c. Since 2017 admissions (other specialties).

2. State educational order:

a. Since 2012 admissions (pedagogical and medical specialties);

b. Since 2017 admissions (other specialties).

3. Doctor of Philosophy (PhD). Since 2012 admissions (all specialties);

4. Higher postgraduate education (magistracy, residency):

a. Since 2016 admissions (pedagogical and medical specialties);

b. Since 2017 admissions (other specialties).

In order to send young specialists and doctors of philosophy (PhD) to work, their personal distribution is carried out. Distribution commissions are created annually at the relevant universities of the Republic of Kazakhstan, in which young specialists and doctors of philosophy (PhD) complete their studies - for personal distribution to work. Young professionals and/or PhDs who do not appear without a valid reason at the relevant Distribution Commission are distributed without their presence.

Temporary deferment and exemption from working off at the time of distribution are possible in the following cases:

1. When entering or calling for military service, a young specialist is granted a deferral for the duration of the service, without taking into account the time of service in the period of working off (Clause 17 of the Decree of the Government of the Republic of Kazakhstan No. 390 of 30.03.2012);

2. persons in the absence of vacancies in the locality at the place of residence, work or service of the spouse;

3. disabled people of I and II groups;

4. persons enrolled for further education in the magistracy, residency, doctoral studies;

5. pregnant women, persons who have, as well as independently raising a child (children) under the age of three years.

On January 8, 2021, No. 410-VI, amendments and additions to the Law of the Republic of Kazakhstan "On Education" were made. According to them, citizens of the Republic of Kazakhstan work off in proportion to the time of their actual training under the state educational order after the end of the organization of higher and (or) postgraduate education within the period provided for by this paragraph, in the following cases:

1) transfer from training on a paid basis to training under the state educational order;

2) transfer from training under the state educational order to training on a paid basis;

3) deductions from the organization of higher and (or) postgraduate education, subject to subsequent recovery during the current or next academic year.

Reimbursement of expenses incurred at the expense of budgetary funds is provided in proportion to the actually worked period according to the formula for determining the working time

For non-fulfillment of the obligation to work off, provided for by the Law, a young specialist and a doctor of philosophy (PhD) shall reimburse the expenses incurred at the expense of budgetary funds in connection with their training. The exception is cases provided for by the Law and these Rules, to the budget through the operator of the authorized body in the region education.
