President Kassym-Jomart Tokayev: We are moving to a new state model, a new format for interaction between the state and society. This qualitative transition can be called the Second Republic

On June 5, 2022, a republican referendum on the Constitution will be held. The Draft Law of the Republic of Kazakhstan "On Amendments and Additions to the Constitution of the Republic of Kazakhstan" will be submitted to a referendum. The wording of the question will be as follows: “Do you accept the amendments and additions to the Constitution of the Republic of Kazakhstan set out in the draft Law of the Republic of Kazakhstan “On amendments and additions to the Constitution of the Republic of Kazakhstan”, published in the media on May 6, 2022”.

The following political transformations in the Republic are planned:

1. Kazakhstan is moving from a super-presidential form of government to a presidential one with a strong parliament;

2. Relatives of the President are prohibited from holding high government positions;

3. Kazakhstanis have the right to independently apply to the Constitutional Court;

4. The land and its bowels belong to the people;

5. The deputy corps of the Mazhilis is formed according to a mixed electoral system;

6. The presidential quota in the Senate will be reduced, the quota of the Assembly of Peoples of Kazakhstan in the Mazhilis will be abolished;

7. The majoritarian system will allow recalling a deputy at the request of voters;

8. The death penalty is prohibited.

In the draft amendments, special attention is paid to the parliamentary system. Today, the Mazhilis of the Parliament (lower house) consists of 107 deputies according to the 1995 Constitution. After the adoption of the draft amendments, there will be 98 of them. Kazakh deputies will be elected according to the system of proportional representation in the territory of a single nationwide constituency, as well as in single-seat territorial constituencies.

Positive changes will also affect the Senate of the Parliament (upper house). Laws will be adopted by the Mazhilis and approved by the Senate - by a majority of votes from the total number of deputies of the chambers. Resolutions of the Parliament and its chambers will be adopted by a majority of votes from the total number of deputies of the chambers. Appointments to the positions of the Chairman of the Constitutional Court, the Chairman of the National Bank, the Chairman of the Supreme Judicial Council, the Prosecutor General and the Chairman of the National Security Committee of the Republic of Kazakhstan will be subject to the consent of the Senate of the Parliament.

The draft amendments to the Constitution were initiated by President Kassym-Jomart Tokayev. “We are moving to a new state model, a new format for interaction between the state and society. This qualitative transition can be called the Second Republic. The working group has prepared amendments to 33 articles of the basic law, and this is a third of the entire Constitution,” the Head of State said on April 29 at the regular session of the Assembly of the People of Kazakhstan. The agenda was "The unity of the people is the basis of a renewed Kazakhstan."
